Terms of Service

1. Definitions

Service - the FindAndDM platform, available at app.findanddm.com, that enables users to discover Instagram influencers and send them direct messages (DMs).

User - any individual or legal entity that registers for and uses the Service.

Account - the user's personal account on the platform, including login details, subscription, and usage data.

2. Age Restriction and Purchase

Use of the Service and purchase of a subscription are only permitted for individuals aged 18 or older. By registering, the user confirms that they are at least 18 years old and have the legal capacity to enter into binding obligations.

3. Description of the Service

FindAndDM is a cloud-based SaaS platform that provides users with tools to discover Instagram influencers and send them direct messages. The Service includes:

  • Search and filtering of 340+ million Instagram content creators
  • Audience and engagement analysis, including fake follower detection
  • Direct messaging to Instagram users from within the platform
  • Campaign tracking and communication management with influencers
  • CRM tools for managing influencer collaborations

The Service does not include physical products, shipping, or inventory. It is a digital subscription for software access only.

4. Registration and User Account

Users must create a personal account by providing accurate and current information. Each user is responsible for maintaining the confidentiality of their login credentials (username and password) and for all activity that occurs under their account.

Account sharing is prohibited, unless a subscription allowing multiple users has been purchased (such as Agency or Enterprise). If unauthorized use of an account occurs, notify FindAndDM immediately.

5. Pricing, Payment, and Subscription Renewal

The Service is offered through several subscription plans: Free, Pro, Agency, and Enterprise. Prices are listed on findanddm.com and may change from time to time.

Automatic renewal: paid subscriptions (monthly or annual) renew automatically at the end of the subscription period, unless the user cancels before the renewal date.

Upfront billing: payment is charged in advance for the upcoming subscription period (month or year, as selected).

Currency: Israeli customers pay in Israeli Shekels (ILS); international customers pay in US Dollars (USD). Payments are processed through a licensed payment provider.

6. Cancellation and Refunds

You may cancel your subscription at any time, without giving a reason, by any of the following methods: through your account settings in the app, by email to hello@findanddm.com, or by any method through which the transaction was made. The cancellation will take effect at the end of the current billing period and no further charges will be made.

Under the Israeli Consumer Protection Law, 1981, you may cancel the transaction within 14 days of the purchase or receipt of these Terms of Service, whichever is later. If cancellation occurs after the Service has been used, the user shall pay the proportional consideration for the period actually used. FindAndDM may charge cancellation fees of up to 5% of the transaction price or 100 NIS, whichever is lower.

A consumer who is a senior citizen (over 65), a new immigrant (within 5 years of receiving immigrant status), or a person with a disability may cancel the transaction within 4 months of the purchase in accordance with the conditions set by law. FindAndDM may request appropriate documentation to exercise this right.

Cancellation due to a defect in the Service or failure to match its description will not incur cancellation fees.

A refund will be made within 14 days of receiving the cancellation notice, to the payment method used for the transaction.

7. Delivery of the Service

Access to the Service is granted immediately after registration and payment, through app.findanddm.com. The Service is available 24 hours a day, 7 days a week, subject to server availability and maintenance work.

There is no physical delivery - the Service is provided entirely digitally.

8. Liability and Limitation of Liability

The Service is provided "as-is". FindAndDM does not guarantee 100% continuous availability and is not responsible for campaign results, influencer responses, or blocks on Instagram accounts.

FindAndDM shall not be liable for direct or indirect damages arising from the use of the Service, including lost profits, lost data, or missed business opportunities, except in cases where such liability cannot be limited by law.

Use of the Service is at the user's sole risk. The user must ensure that their use complies with Instagram's and Meta's terms of service.

9. Acceptable and Prohibited Use

The user undertakes to use the Service only for lawful purposes and in accordance with the terms of service of Instagram and Meta Platforms, Inc.

Prohibited:

  • Sending spam or mass irrelevant messages
  • Sending offensive, misleading, threatening, or illegal content
  • Violating the terms of service of Instagram or Meta
  • Attempting to hack, damage, or disrupt the Service
  • Copying, reproducing, or reselling the Service without permission

FindAndDM reserves the right to block or suspend accounts that violate these terms, without refund.

10. Intellectual Property

All rights in the platform, including design, code, logo, text, and any other content, belong to FindAndDM. Copying, reproducing, distributing, or using these materials commercially without prior written approval is prohibited.

11. Changes to These Terms

FindAndDM may update these Terms of Service from time to time. Material changes will be posted on the website and/or sent to users by email. Continued use of the Service after such changes constitutes acceptance of the updated terms.

12. Force Majeure

FindAndDM shall not be liable for delays or disruptions in the Service caused by circumstances beyond its control, including internet disruptions, third-party server failures, natural disasters, war, strikes, or orders of a competent authority.

13. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the State of Israel. The exclusive jurisdiction for any dispute arising from these terms or from the use of the Service lies with the competent courts in Tel Aviv-Yafo, Israel.
